Agreement to Terms

By accessing or using Second Wind services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

Description of Services

Second Wind provides GEO (Generative Engine Optimization) and AI representation control for category leaders. Our platform helps you shape how AI systems and answer engines describe, cite, and recommend your company. Services include:

• Continuous monitoring of how AI models represent your organization across ChatGPT, Claude, Gemini, Perplexity, Grok, and other systems
• AI visibility scoring, default-status analysis, and competitive benchmarking
• Cross-model audits and studies (e.g., role assignment, niche-boxing, specialist containment)
• Reporting dashboards and competitive intelligence
• AI Pages Library and AI-facing content surfaces where applicable
• Methodology and insights for owning your presence in AI-mediated discovery

User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Use our services only for lawful purposes
• Comply with all applicable laws and regulations
• Not interfere with or disrupt our services

Payment Terms

Payment for services is due according to the agreed-upon schedule. Late payments may result in service suspension. All fees are non-refundable except as specifically stated in our refund policy or required by law.

Intellectual Property

Second Wind’s platform technology, methodologies, and GEO tools remain our intellectual property. You receive a license to use our platform and access the insights, reports, and deliverables generated for your organization. You retain full ownership of your company’s content, data, and brand assets.

AI Representation and Accuracy

Our platform monitors and optimizes how AI systems and answer engines represent your organization (GEO). We cannot guarantee how third-party AI systems will respond to queries about your business. You remain responsible for ensuring all information you provide is accurate and complies with your industry’s regulatory requirements. We recommend reviewing visibility and positioning insights with your compliance and legal teams as appropriate.

Service Level Agreement

We strive to provide:

• Reliable operation of our GEO and AI visibility platform
• Monitoring and scoring updates as per your plan
• High platform availability
• Responsive support for platform inquiries and technical issues
• Custom SLA options for enterprise clients where agreed

Limitation of Liability

To the maximum extent permitted by law, Second Wind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

Termination

Either party may terminate services with 30 days’ written notice. We may terminate immediately for breach of these terms. Upon termination, you will receive a final export of your visibility data, reports, and platform deliverables for a transition period of 30 days where applicable.

Governing Law

These terms are governed by the laws of Massachusetts, United States. Any disputes will be resolved in the courts of Massachusetts.

Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by email or through our platform. Continued use of our services constitutes acceptance of the updated terms.
